Energy Efficiency Act and Regulations

To Whom Does This Apply?

To dealers who import into Canada or ship from one province or territory to another energy-using products. The Act defines a dealer as a manufacturer of energy-using products in Canada, a person engaged in the business of importing energy-using products into Canada, or a person who sells or leases energy-using products obtained directly or indirectly from the manufacturer or importer.

Summary

The Energy Efficiency Act and Regulations set minimum energy-efficiency standards for specified energy-using products and provide descriptions of the responsibilities of dealers with respect to these products. The Act also sets out labelling standards for energy-using products, as well as the collection of statistics and information on energy use and alternative energy.

 

The Energy Efficiency Regulations apply to energy-using products imported into Canada or manufactured in Canada and shipped from one province or territory to another for the purpose of sale or lease. The Regulations continue to apply to an energy-using product even if it has been incorporated into another product.

The following categories of energy-using products fall under the scope of the Energy Efficiency Regulations:

  • household appliances;
  • water heaters;
  • heating and air conditioning equipment;
  • lighting products;
  • other energy-using products.

Responsibilities of a Dealer
The dealer must:

  • ensure the product meets the energy efficiency standard specified in the Regulations;
  • ensure an energy efficiency report has been filed with NRCan;
  • provide the necessary import information to the Canada Border Services Agency, when importing products:
    • name of product;
    • model number;
    • brand name, if any;
    • name and address of the dealer who is importing the product; and
    • the purpose for which the product is being imported.
  • ensure the product bears an energy efficiency verification mark. This mark indicates that the energy performance of the product has been verified. It must be the mark of either a recognized verification agency or a province or territory. The mark must be placed on the exterior of the product;
  • ensure an EnerGuide label is affixed to the product, if prescribed by the Regulations. The label must remain on the product until it is sold or leased.
